These Terms of Service (“Terms”) govern your access to and use of KTIZO(“KTIZO,” “we,” “us”), operated by [COMPANY LEGAL NAME]. By creating an account or using the service, you agree to these Terms.
1. The service
KTIZO is (a) a platform where independent 3D-printing shops (“Shops”) sell printing services and products to customers (“Customers”), and (b) subscription software that Shops use to run their business (quoting, orders, payments, fulfillment). Shops are independent businesses; KTIZO is not the seller of, and is not responsible for, the prints or products Shops provide.
2. Accounts & eligibility
You must be at least 18 (or the age of majority in your jurisdiction) and able to form a binding contract. You are responsible for your account credentials and all activity under your account. Provide accurate information and keep it current.
3. Acceptable use
You agree not to:
- Upload or order content you don't have the rights to, or that infringes others' rights.
- Request prints of illegal items (e.g. weapons prohibited by law), or use the service for unlawful purposes.
- Abuse, reverse-engineer, scrape, or overload the service, or interfere with its security.
- Misrepresent your identity or a Shop's business.
4. User content & intellectual property
You keep ownership of your files. You retain all rights to the 3D models and other content you upload (“User Content”). To operate the service, you grant KTIZO and the Shop you order from a limited, worldwide, non-exclusive license to host, store, process, and display your User Content solely to provide the service (e.g. to compute a quote, render a preview, and print your order). This license ends when you delete the content or close your account, except for copies retained as required by law or for backups.
You represent that you own or are licensed to use your User Content and that it does not infringe any third party's intellectual-property or other rights. Do not upload designs you are not permitted to reproduce.
5. IP infringement & takedowns (DMCA-style)
We respect intellectual-property rights and expect users to do the same. If you believe content on the platform infringes your rights, send a notice to [CONTACT EMAIL] including: (a) identification of the work; (b) the location of the allegedly infringing content; (c) your contact information; (d) a statement of good-faith belief that the use is unauthorized; (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act; and (f) your signature. We may remove allegedly infringing content and terminate repeat infringers. A counter-notice process is available to the affected user.
6. Payments & subscriptions
Customers pay Shops for orders through the platform's payment processor (e.g. Stripe). Shops pay KTIZO a subscription fee and/or a platform fee on processed payments per the plan they select. Fees are described at sign-up and on the pricing page and may change with notice. Print-order refunds are handled by the Shop under its own policy and our Refund Policy.
7. Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind, to the maximum extent permitted by law. Quotes are automated estimates; print outcomes depend on the Shop and your files. KTIZO does not guarantee uninterrupted or error-free operation.
8. Limitation of liability
To the maximum extent permitted by law, KTIZO and [COMPANY LEGAL NAME] will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
9. Termination
You may stop using the service at any time. We may suspend or terminate accounts that violate these Terms or to protect the platform. Sections that by their nature should survive termination (IP, disclaimers, liability) survive.
10. Governing law
