These Terms of Service (“Terms”) govern your access to and use of KTIZO 3D(“KTIZO 3D,” “we,” “us”), operated by Digital Oasis LLC. By creating an account or using the service, you agree to these Terms. If you operate a shop on the platform, you also agree to the Seller Agreement, which is part of these Terms for shops.
1. What KTIZO 3D is — a venue, not the seller
KTIZO 3D is software and a venue: (a) subscription tools that independent 3D-printing businesses (“Shops”) use to run their operations — quoting, orders, payments, job tracking, storefronts — and (b) a place where Shops offer printing services and products to buyers (“Customers”).
When you buy from a Shop, your purchase contract is between you and that Shop — not with KTIZO 3D. Shops are independent businesses. They are not our employees, agents, partners, or franchisees, and we do not manufacture, inspect, warehouse, ship, or take title to anything a Shop sells. Each Shop is solely responsible for its listings, prices, product quality and safety, intellectual-property compliance, fulfillment, shipping, returns, refunds, and customer service, as detailed in the Seller Agreement.
We do not endorse any Shop or guarantee any outcome. Automated quotes are estimates produced from your file and the Shop's settings; the Shop is responsible for the final product.
2. Accounts & eligibility
You must be at least 18 (or the age of majority in your jurisdiction) and able to form a binding contract. You are responsible for your account credentials and all activity under your account. Provide accurate information and keep it current.
3. Acceptable use
You agree not to:
- Upload, list, order, or print content you don't have the rights to, or that infringes others' intellectual-property or other rights.
- List, order, or print anything on the Prohibited Items list, or use the service for unlawful purposes.
- Abuse, reverse-engineer, scrape, or overload the service, or interfere with its security.
- Misrepresent your identity or a Shop's business.
- Circumvent the platform (e.g. use it to source a customer and move the sale off-platform to avoid fees).
4. User content & intellectual property
You keep ownership of your files. You retain all rights to the 3D models and other content you upload (“User Content”). To operate the service, you grant KTIZO 3D and the Shop you order from a limited, worldwide, non-exclusive license to host, store, process, and display your User Content solely to provide the service (e.g. to compute a quote, render a preview, and print your order). This license ends when you delete the content or close your account, except for copies retained as required by law or for backups.
You represent that you own or are licensed to use your User Content and that it does not infringe any third party's rights. Do not upload designs you are not permitted to reproduce. Infringement reports and takedowns are handled under our IP & DMCA Policy; repeat infringers will have their accounts terminated.
5. Payments, fees & refunds
Customers pay Shops for orders through the platform's payment processor (e.g. Stripe). Shops pay KTIZO 3D a subscription fee and/or a platform fee on processed payments per the plan they select. Fees are described at sign-up and on the pricing page and may change with notice.
Order refunds and returns are between you and the Shop, under the Shop's policy and our Refund Policy. KTIZO 3D may assist with payment mechanics (e.g. processing a refund a Shop issues) but is not obligated to referee disputes and is not liable for a Shop's goods or services.
6. Content moderation & enforcement
We may (but are not obligated to) review, refuse, or remove any listing or content, and may suspend or terminate accounts, where we believe these Terms, the Prohibited Items policy, the IP & DMCA Policy, or applicable law is being violated, or to protect users or the platform. We may report illegal activity to authorities.
7. Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind, to the maximum extent permitted by law. KTIZO 3D makes no warranty regarding — and expressly disclaims responsibility for — the quality, safety, legality, or fitness for purpose of anything a Shop produces or sells. Quotes are automated estimates; print outcomes depend on the Shop and your files. KTIZO 3D does not guarantee uninterrupted or error-free operation.
8. Limitation of liability
To the maximum extent permitted by law, KTIZO 3D and Digital Oasis LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, or for any claim arising from a product or service provided by a Shop. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
9. Termination
You may stop using the service at any time. We may suspend or terminate accounts that violate these Terms or to protect the platform. Sections that by their nature should survive termination (IP, disclaimers, indemnities, liability) survive.
10. Governing law
These Terms are governed by the laws of the State of Hawaii, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Hawaii, unless otherwise required by applicable law.
11. Changes
We may update these Terms; material changes will be posted here with a new effective date. Continued use after changes means you accept them. Questions? Contact [email protected].
